What We Found

No Minnesota law allows killing a baby after birth. Under Minn. Stat. 145.423, a born-alive infant is still "fully recognized as a human person," and killing a newborn is still homicide.

The photo appears to be the Jan. 31, 2023 PRO Act signing, which was a different bill from the born-alive change.

What's real: in May 2023, the law's wording changed from requiring staff to "preserve the life and health" of a born-alive infant to "care for" the infant.

Critics (MCCL) say this could let babies be denied lifesaving care. Supporters (bill co-author Rep. Tina Liebling) say it allows comfort care when a baby can't survive and "does not legalize infanticide."
